Attorneys Shouldn’t Be Filling False Claims

Claims that Voters Fraud was Committed Was Tossed-Out of Courtrooms

Going forward the states whereas the false claims was made should take a serious consideration as too why lawyers continued, to make false claims, sanctions should come as a results…

In light of the baseless allegations of election fraud the attorneys who on behalf of the Trump administration filed the petitions that fraud was in several states concludes that voting was fraudulent without bringing any shred of evidence. Should these attorneys be sanctioned? I don’t know as a matter of fact, but seemly too a layperson it does. The Washington Post reported that 1500 attorneys filed a petition for sanctions. Will the American people allow this administration to violate bar rules and watch a democracy be challenged and the presidential elections be decided in the courts and disobey the will of the people.

Rule 3.1Meritorious Claims And Contentions

A lawyer shall not bring or defend a proceeding, or assert or controvert an issue therein, unless there is a basis in law and fact for doing so that is not frivolous, which includes a good faith argument for an extension, modification or reversal of existing law. A lawyer for the defendant in a criminal proceeding, or the respondent in a proceeding that could result in incarceration, may nevertheless so defend the proceeding as to require that every element of the case be established.

Rule 4.1: Truthfulness in Statements to Others

In the course of representing a client a lawyer shall not knowingly:

(a) make a false statement of material fact or law to a third person; or

(b) fail to disclose a material fact to a third person when disclosure is necessary to avoid assisting a criminal or fraudulent act by a client, unless disclosure is prohibited by Rule 1.6.

It is professional misconduct for a lawyer to:

  1. violate or attempt to violate the Rules of Professional Conduct, knowingly assist or induce another to do so, or do so through the acts of another;

In the petitions filed by the Trump attorneys didn’t demonstrate any claim that any electors or the Board of the County were guilty of fraud. Most of the claims made argument as “inadmissible hearsay within hearsay.” The court asserted that to the attorneys be inform you that your submission is defective. Too many false claims was made under the pretext of voter fraud, which not one shred of evidence wasn’t given in any of the petitions. The Trump lawyers found themselves backpedaling when pressed in court for admissible evidence, or dropping out when they were accused of helping derail the democratic process. Nationally, it’s becoming clear that a Biden win in Pennsylvania, Michigan, Arizona, and Wisconsin with enough electoral votes, was imminent. The Trump’s legal team cried vote fraud, but courts found none…
